Who we are

Kizmett Realty and Management Ltd. ("Kizmett," "we," "us") is a real estate brokerage and property management company licensed in Alberta. Emily Loomis is the broker and owner. This policy explains how we collect, use, disclose and protect personal information in accordance with Alberta's Personal Information Protection Act (PIPA), Canada's Anti-Spam Legislation (CASL), and other laws that apply to our business. This policy applies to our websites (including rentwithloomis.com), our booking and contact forms, and the services we provide to landlords, tenants, buyers and sellers.

What information we collect

The information we collect depends on how you deal with us. It may include:

• Contact details: name, phone number, email address, mailing address, and the address or community of your rental property.

• Inquiry details: the service you are interested in, your property details, your goals, and your preferred contact times.

• Landlord and owner information: ownership details, title information, banking information for owner payments, insurance details and the documents needed to provide our services.

• Tenant and applicant information: application details, employment and income information, credit information, references, identification, rental history and lease information, collected with your consent.

• Identification and transaction records: information we are required to collect and keep to meet legal obligations, including identification and records required under federal anti-money-laundering law.

• Communications: emails, texts, call notes and messages you send us.

• Website information: technical information such as your device, browser and pages visited, collected through cookies and similar technologies (see section 9).

 

Why we collect it

We collect, use and disclose personal information for purposes that a reasonable person would consider appropriate, including to:

• respond to your inquiries and book consultations;

• provide the services you request, such as listing a rental, screening tenants, preparing leases, conducting inspections and managing properties;

• screen rental applicants and verify identity, income and references;

• collect rent, pay owners, and keep accounting and trust records;

• communicate with you about your inquiry, services and (with your consent) other landlord services;

• meet our legal, regulatory and professional obligations, including those under the Real Estate Act and its Rules, and anti-money-laundering requirements;

• manage our business, including record keeping, security and fraud prevention;

• improve our website and services.

We will tell you the purpose at or before the time we collect your information, unless the purpose is obvious.

 

Your consent

We collect, use and disclose your personal information with your consent, except where the law allows or requires otherwise.

• When you submit a form on our website and tick the consent box, you agree that we may call, text and email you about your inquiry and about landlord services.

• You can withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may mean we can no longer provide certain services.

• To stop emails: use the unsubscribe link in any email.

• To stop texts: reply STOP to any text.

• To stop everything or ask a question: contact our privacy officer using the details above. We will act on unsubscribe requests within 10 business days.

Every commercial electronic message we send identifies us and includes our contact information and a way to unsubscribe.

 

Who we share information with

We do not sell your personal information. We share it only as needed for the purposes above, including with:

• Service providers who help us run our business, such as website hosting, customer relationship management, online booking and payment, email and text messaging, property management software, accounting and document signing providers. They may use your information only to provide services to us.

• Other parties to a transaction, such as owners, tenants, lawyers, lenders, inspectors, contractors, insurers, condominium corporations and other real estate professionals, where needed to provide the service.

• Credit reporting agencies and screening providers, with the applicant's consent.

• Listing and marketing platforms, such as REALTOR.ca, MLS® systems and rental sites, for properties you ask us to list.

• Regulators, courts and government agencies, where required or permitted by law, such as the Real Estate Council of Alberta (RECA) or the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC).

• Professional advisors, such as lawyers and accountants, under duties of confidentiality.

• A buyer or successor, if our business is sold or restructured, subject to privacy protections.

 

Service providers outside Canada

Some of our service providers are located in, or store information in, other countries, including the United States. When your information is processed outside Canada, it may be subject to the laws of that country, including laws that allow courts and authorities to access it. If you have questions about our use of service providers outside Canada, contact our privacy officer using the details in section 2.

 

How we protect your information

We use reasonable safeguards appropriate to the sensitivity of the information, including password protection, access limited to people who need it, secure storage and secure disposal. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach creates a real risk of significant harm to an individual, we will notify the Alberta Information and Privacy Commissioner and affected individuals as the law requires.

 

Cookies and website tracking

Our website may use cookies and similar technologies to make the site work, remember your preferences and understand how visitors use the site.  You can control cookies through your browser settings, though some parts of the site may not work properly if you disable them.

Our website may contain links to other sites. We are not responsible for the privacy practices of those sites.

 

How long we keep information

We keep personal information only as long as needed for the purposes above and as required by law. Real estate brokerages and property managers must keep certain transaction, trust and identification records for periods set by the Real Estate Act Rules, federal law and tax rules. When information is no longer needed, we securely destroy it or make it anonymous.

 

Your rights: access and correction

You have the right to:

• ask whether we hold personal information about you and request access to it;

• ask how we have used and disclosed it;

• ask us to correct information that is inaccurate or incomplete.

Send your request in writing to our privacy officer. We may need to verify your identity first. We will respond within the time required by PIPA, generally within 45 days. In limited cases the law allows or requires us to refuse access (for example, where the information contains another person's personal information or is subject to legal privilege), and we will explain our reasons.

 

Questions and complaints

If you have a concern about how we handle your personal information, contact our privacy officer first and we will work to resolve it. If you are not satisfied, you may contact the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca).

 

Changes to this policy

We may update this policy from time to time. The effective date at the top shows when it was last changed. We encourage you to review it periodically.
