Thank you for visiting. These Terms of Use (the “Terms”) are a binding agreement between you and Kizmett Realty and Management Ltd. (“Kizmett,” “we,” “us” or “our”), which operates Listed & Leased with Emily and Rent with Loomis. They apply when you:

• (a) visit our websites, including listedandleased.ca, rentwithloomis.com and any other site we operate (the “Websites”);

• (b) use our online tools, calculators and resources (the “Tools”);

• (c) submit a form, book a call, request a showing, or sign up for our emails or text messages; or

• (d) view or interact with our content on third-party platforms such as YouTube, Instagram, TikTok and Facebook.

Together, these are the “Services.” By using any of the Services, you agree to these Terms. If you do not agree, please do not use them.

Who We Are

Kizmett Realty and Management Ltd. is a real estate brokerage located at Suite 535, 9768 170 Street NW, Edmonton, Alberta T5T 5L4. Emily Loomis is the Broker/Owner. Listed & Leased with Emily offers flexible, pay-as-you-go services and tools for landlords. Rent with Loomis is our rental leasing and tenant-facing brand.

 

What the Services Are, and Are Not

The Services provide general information, planning tools, rental listings and ways to contact us. They are not legal, tax, accounting, financial, mortgage or investment advice. Please consult your own professional advisors before making decisions about a property.

Using the Services does not create a brokerage, agency, property management, membership or client relationship with us. A relationship of that kind begins only when you and Kizmett sign a written agreement (for example a service agreement, membership agreement or leasing agreement). If a signed agreement conflicts with these Terms, the signed agreement controls for the services it covers.

Tools and Calculators

Our Tools, including the vacancy cost calculator, produce estimates based on the numbers you enter and the assumptions stated on the Tool. Please note:

• Amounts are in Canadian dollars and are used as you enter them. Tools do not add or remove GST unless they say so.

• We do not verify your inputs. Results are rounded and are only as accurate as the information you provide.

• Default numbers are examples you can change. They are not quotes, offers, guarantees or predictions of your actual costs, rents or returns.

• Actual rents, expenses, vacancy periods and fees vary. Please do not rely on a Tool as the only basis for a decision.

• Nothing you enter into a Tool is saved unless you choose to have your results emailed to you. If you do, we collect and use your information as described in Section 7.

Who May Use the Services

You must be at least 18 years old and able to enter into a binding contract. You may use the Services for your own personal or business needs as a landlord, tenant or prospective client, or to learn about our services. You agree that any information you give us is accurate, current and complete.

Prohibited Uses

You agree not to use the Services to:

• (a) break any law or regulation, or infringe anyone’s rights, including intellectual property or privacy rights;

• (b) submit false, misleading or fraudulent information, or impersonate another person;

• (c) harass, threaten, defame or harm anyone;

• (d) copy, scrape, harvest or systematically collect content, listings or data from the Services by automated means without our written permission;

• (e) probe, scan or test the security of the Websites, interfere with their operation, or place an unreasonable load on them;

• (f) introduce viruses or other harmful code;

• (g) modify, reverse engineer or create derivative works from our Tools or content, or remove ownership notices from them;

• (h) resell or use the Tools or content commercially, or in your own advertising, without our written consent; or

• (i) help or allow anyone else to do any of the above.

We may suspend or block access to the Services if you break these Terms.

Communications and Consent

Email and text marketing. If you submit a form, tick a consent box, sign up for a newsletter or otherwise ask to hear from us, you give us your express consent to send you emails (and text messages, if you provide a mobile number and agree to texts) about our services, rental listings, landlord tips, newsletters, reminders and similar content. If you give us your birthday, which is optional, we may use it to send you a greeting. Message and data rates from your carrier may apply to texts.

Inquiries. If you contact us about a rental, a service or a property, we may reply to you and follow up about your inquiry.

Unsubscribing. You can withdraw your consent at any time by clicking “unsubscribe” in any of our emails, replying STOP to any text, or contacting us using the details in Section 17. We will act on your request as soon as possible and within 10 business days. After you unsubscribe, we may still send you messages you need to receive, such as confirmations for bookings, applications, showings or services you have requested.

Who you are. By giving us an email address or phone number, you confirm that it is yours or that you are allowed to use it.

 

Your Personal Information

We collect, use and share personal information as described in our Privacy Policy, which forms part of these Terms. We handle personal information in line with Alberta’s Personal Information Protection Act and, where it applies, Canada’s Personal Information Protection and Electronic Documents Act. If you submit a rental application or sign a service agreement, we may collect additional information under separate consent forms.

 

Rental Listings and Property Information

Listings and property details on our Websites are provided for general information. Availability, rent, features and photos can change without notice, and photos may not show the exact unit. Please confirm important details before relying on them. Submitting an inquiry or application does not guarantee a showing or a tenancy. Applications are reviewed with the property owner and handled in accordance with applicable law, including Alberta’s Residential Tenancies Act and the Alberta Human Rights Act.

Third-Party Websites and Services

The Services may link to or rely on third-party websites, platforms and service providers, such as booking and payment providers, our tenant portal and maintenance request system, email and text providers, and social media platforms. We do not own or control them and are not responsible for their content, availability, privacy practices or terms. Your use of them is at your own risk and is governed by their own terms and policies. Any dealings you have with other landlords, tenants, contractors or professionals you find through or because of the Services are between you and them.

Ownership of Content

The Services, including our text, videos, images, logos, designs, Tools and software, are owned by us or used with permission, and are protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to view and use the Services as these Terms allow. You may share links to our pages and videos. Other than that, you may not copy, reproduce, distribute or publicly display our content without our prior written permission. All rights not expressly granted are reserved.

The trademarks REALTOR®, REALTORS® and the REALTOR® logo are controlled by The Canadian Real Estate Association (CREA) and identify real estate professionals who are members of CREA.

If you send us comments, questions or feedback, you agree that we may use them to respond to you and to improve our Services. We will not publish your name or testimonial without your permission.

Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we do not promise that the Services or any information, estimate or Tool result will be accurate, complete, current, error-free or uninterrupted, or that they will meet your needs. Information on the Services may include opinions, humour and general commentary that should not be treated as advice.

Limitation of Liability

To the fullest extent permitted by law, Kizmett and its directors, officers, employees, agents and service providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, rent, savings or data, arising from your use of, or inability to use, the Services or any Tool, even if we were told such damages were possible. For claims connected to the free Services, our total liability to you will not exceed CAD $10.

Nothing in these Terms limits liability that cannot be limited by law, or affects our obligations under a written agreement with you or under the Real Estate Act and the rules of the Real Estate Council of Alberta (RECA).

Indemnity

To the extent permitted by law, you agree to defend and compensate us and our directors, officers, employees and agents for claims, losses and reasonable costs that arise from your breach of these Terms or your misuse of the Services.

Changes and Availability

We may update these Terms from time to time. The latest version will be posted on the Websites with its effective date, and your continued use of the Services after that date means you accept the changes. We may change, suspend or discontinue any part of the Services, including any Tool, at any time.

Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. If you have a concern, please contact us first so we can try to resolve it informally. If we cannot, the courts of Alberta, sitting in Edmonton, have jurisdiction, and you and we both agree to that. Nothing in these Terms prevents you from making a complaint to a regulator, such as RECA or the Office of the Information and Privacy Commissioner of Alberta.

 

General

These Terms, together with our Privacy Policy and any written agreement between you and us, are the entire agreement about your use of the Services. If any part of these Terms is found invalid or unenforceable, the rest stays in effect. If we do not enforce a provision, we have not given it up. We may assign these Terms to a successor. You may not assign them without our written consent. We may give you notice by email or by posting on the Websites. These Terms are written in English.
